Agreement to Terms
By accessing or using TraceKit.Dev (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.
Description of Service
TraceKit is a distributed tracing and application performance monitoring (APM) platform that helps developers debug production issues faster. We provide:
- Automatic distributed tracing
- Performance monitoring and metrics
- Error tracking and alerting
- Service dependency mapping
- Log correlation
- AI-powered trace analysis
Account Registration
Eligibility
You must be at least 16 years old and have the authority to enter into this agreement. By registering, you represent that:
- All information provided is accurate and current
- You will maintain the accuracy of such information
- You are authorized to use the Service on behalf of your organization (if applicable)
Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities under your account
- Notifying us immediately of unauthorized use
We reserve the right to suspend accounts that violate these terms.
Subscription Plans and Billing
Free Trial
- 7-day free trial available for all plans
- Full access to features during trial
- $0 charged until trial ends
- Cancel anytime during trial with no charges
Paid Subscriptions
Available Plans:
- Starter: 1M requests/month – $29/month
- Growth: 10M requests/month – $99/month
- Pro: 50M requests/month – $299/month
Billing Terms:
- Billed monthly in advance
- Automatic renewal unless cancelled
- Prices subject to change with 30 days notice
- Charges are non-refundable except as required by law
Payment Processing
- Payments processed securely through Stripe
- You authorize us to charge your payment method
- Failed payments may result in service suspension
- We’ll attempt to notify you of payment failures
Overages
If you exceed your plan limits:
- We’ll notify you via email
- You’ll need to upgrade to a higher plan
- We reserve the right to throttle service if limits are consistently exceeded
Cancellation
You may cancel anytime:
- Cancel through account settings or contact support
- Access continues until end of billing period
- No refunds for partial months
- Data retained for 30 days after cancellation
Acceptable Use Policy
You May:
- ✅ Use TraceKit for legitimate business purposes
- ✅ Send trace data from your applications
- ✅ Share access with team members
- ✅ Integrate with your development workflow
You May Not:
- ❌ Use the Service for illegal purposes
- ❌ Transmit malware, viruses, or harmful code
- ❌ Attempt to breach security or access other users’ data
- ❌ Reverse engineer or copy the Service
- ❌ Resell or redistribute the Service
- ❌ Send excessive or abusive API requests
- ❌ Scrape or crawl the Service
- ❌ Use the Service to compete with TraceKit
Enforcement
Violations may result in:
- Warning and request to cease activity
- Temporary suspension
- Permanent account termination
- Legal action if warranted
Your Data
Data Ownership
- You own your data: All traces, logs, and metrics you send remain your property
- License to Process: You grant us permission to process your data to provide the Service
- Aggregated Data: We may use anonymized, aggregated data for analytics and improvements
Data Privacy
- See our Privacy Policy for how we handle your data
- We implement industry-standard security measures
- Data encrypted in transit (TLS 1.3) and at rest (AES-256)
Data Retention
- Trace data retained according to your plan (7-90 days)
- Account data retained while account is active
- Deleted data purged within 30 days
Data Deletion
You can:
- Delete individual traces through the UI
- Delete your entire account (Settings → Delete Account)
- Request immediate data deletion: [email protected]
Intellectual Property
Our IP
TraceKit owns all rights to:
- The Service, platform, and technology
- TraceKit name, logo, and branding
- All documentation and content we create
- Software, code, and algorithms
You may not use our IP without written permission.
Your IP
You retain all rights to:
- Your application code
- Your trace data
- Your company name and branding
We claim no ownership of your intellectual property.
Feedback
If you provide feedback or suggestions:
- We may use them without obligation
- You grant us a perpetual, royalty-free license
- We appreciate feedback but aren’t required to implement it
Service Availability
Uptime Commitment
We strive for 99.9% uptime but don’t guarantee it. We’ll notify you of:
- Scheduled maintenance (72 hours notice when possible)
- Major outages affecting service
Service Changes
We reserve the right to:
- Modify features or functionality
- Add or remove integrations
- Change API endpoints (with notice)
- Discontinue the Service (60 days notice)
Support
Support levels vary by plan:
- Starter: Email support (24-hour response)
- Growth: Email + chat support (12-hour response)
- Pro: Priority support (4-hour response)
Disclaimers and Limitations
Service “As Is”
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE’RE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY IS LIMITED TO FEES PAID IN THE LAST 12 MONTHS
- WE’RE NOT LIABLE FOR DATA LOSS, BUSINESS INTERRUPTION, OR LOST PROFITS
This applies even if we’ve been advised of the possibility of such damages.
No Guarantee of Results
While we aim to help you debug faster:
- We don’t guarantee specific performance improvements
- Results depend on your application and how you use the Service
- Testimonials reflect individual experiences
Indemnification
You agree to indemnify and hold harmless TraceKit from claims arising from:
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your use of the Service
- Your data or content
Termination
By You
You may terminate by:
- Cancelling your subscription
- Deleting your account
- Contacting support
By Us
We may terminate or suspend your account if:
- You violate these Terms
- You provide false information
- Your payment method fails
- Required by law
- You engage in fraudulent activity
Effect of Termination
Upon termination:
- Your access to the Service ends immediately
- We’ll delete your data per our retention policy
- You remain liable for fees incurred before termination
- Provisions that should survive termination will (e.g., indemnification, limitations of liability)
Dispute Resolution
Governing Law
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law provisions.
Arbitration
Any disputes will be resolved through binding arbitration, except:
- Small claims court disputes
- Intellectual property disputes
